Are You Responsible for Selling Cars that Are Part of an Estate?

When our loved ones pass away, they often leave all sorts of assets and valuables like cars, their house, and so on. Being put in charge of an estate is an important responsibility. You need to make sure you are following estate laws, as well as the wishes of the decedent.

Fortunately, if the decedent did not leave their vehicles to anyone in their will, or there is not a surviving spouse or partner, who could claim the vehicle, things are a bit easier when it comes to selling the cars using the following steps:

Step 1: Go to Probate Court.

The first thing you need to do is attend a Probate Court hearing. Your purpose is to provide a copy of the will to the Court showing you are the executor of the estate. If there was no will, you still need to go to Court and get permission from the Court to be the executor of the estate.

Step 2: Transfer the Titles of All Vehicles

Once you have been made executor of the estate, you will have the power to transfer the car titles into your name. You will need to provide a copy of the death certificate and documentation showing you are the executor when you request the title transfers.

Step 3: Confirm the Vehicles Are Paid in Full

Before you can sell the vehicles, you need to verify there are no liens. If there is a car loan on the vehicles, you will need to contact the lenders to find out the payoff amount. It is also a good idea to see if the decedent had insurance to pay the loans off in the event of their death.

Step 4: Verify that the Vehicles Were Not Left to Anyone

Take the time to read through the will of the decedent. You need to verify they did not intend the vehicle to go to a surviving relative, friend, or charity. If the vehicle is not listed in the will, then you can dispose of it how you see fit as long as it is paid in full.
